Terms of Service

These Terms govern your use of favouriteVideo (the "Service") at favouritevideo.app. By signing in or using the Service you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

• You must be at least 18 years old to use the Service.
• You sign in with a Google account. You are responsible for all activity under your account.
• One person may not create multiple accounts to collect additional sign-up credits.

2. What the Service does

The Service uses third-party AI video models to replace the person in a short video with the person in your photos ("Video Recast") or to animate a photo with the movement from a reference video ("Motion Transfer"). Results are generated automatically and may be inaccurate, inconsistent with your inputs, or differ from previous results for the same inputs. We do not guarantee any particular outcome.

3. Your content and consent

• You may only upload photos, videos and links ("Inputs") that you own or are licensed to use, and only depict real people who have given you their consent to be used this way.
• You keep ownership of your Inputs. You grant us a limited licence to store, process and transmit them to our service providers solely to operate the Service for you.
• Subject to these Terms and the rights of others, you may use the videos you generate ("Outputs"). You are responsible for how you use and share them, including labelling them as AI-generated where the law requires it.

4. Prohibited uses

You must not use the Service to create, upload or share content that:

• depicts a minor, or is sexual, nude or sexually suggestive;
• uses a person's likeness without their consent, including public figures and celebrities;
• impersonates someone, or is intended to deceive, defraud, harass, bully, threaten or defame;
• is misleading political or news content, or presents fabricated events as real;
• infringes copyright, trademark, publicity, privacy or other rights;
• is violent, hateful, or otherwise illegal where you live or where it is published.

You also must not attempt to circumvent credit charges, probe or overload the Service, or access it by automated means other than through our website.

5. Credits and payments

• Generations are paid with credits. Prices are shown on the Pricing page and before each generation is submitted. Credits are deducted when a generation starts.
• Credit purchases are processed by Creem, our merchant of record, which handles payment, invoicing and applicable sales taxes. Your payment details are never shared with us.
• Credits have no cash value, cannot be transferred or resold, and can only be used on the Service. The 30 free credits given at sign-up are promotional and are never refundable.
• Failed generations are refunded in credits automatically. Other refunds follow our Refund Policy.

6. Storage

Inputs and Outputs are stored for a limited time, as described in the Privacy Policy, and then deleted automatically. Download any Output you want to keep. We are not a backup service.

7. Enforcement

We may remove content, refuse or cancel generations, and suspend or close accounts that violate these Terms or that we reasonably believe expose us, our providers or others to legal risk or harm. Credits spent on prohibited content are not refunded. We may report illegal content, including child sexual abuse material, to the authorities. To report content that misuses your likeness or infringes your rights, email support@favouritevideo.app.

8. Disclaimers and liability

The Service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. We are not liable for indirect, incidental or consequential damages, or for loss of data or content. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer law that cannot be waived.

You agree to indemnify us against claims arising from your Inputs, your Outputs, or your breach of these Terms.

9. Changes and termination

We may update these Terms; the date above shows the latest version, and continued use after a change means you accept it. You may stop using the Service at any time and ask us to delete your account. We may change or discontinue features; if we shut down the Service, we will give reasonable notice.
